General Terms and Conditions of Sale

1. Preamble

The following General Terms and Conditions of Sale regulate the offer and sale of products and services on the "www.dorlindon.com" website (from now on "Website").

The user that accesses the Website (from now on "Customer") must read these General Terms and Conditions of Sale carefully, especially before ordering any product or service. Executing a purchase order the Customer declares to have read and fully understood the informations of the following document, and to accept the General Terms and Conditions of Sale here presented.
The Customer is advised to read, if he hasn't already done so, also the General Terms and Conditions of Use page of the Website, which also contain important information.

The products and services commercialized within the Website (from now on "Products") are supplied and sold directly by Dorlindon, 278 Glasnevin Avenue, Glasnevin, Dublin 11, Ireland, email address info@dorlindon.com, owner of the registered trademark "Dorlindon" (from now on "Dorlindon") and of the "www.dorlindon.com" website.

Dorlindon is the only rights-holder on domains, logos, trademarks and copyrights applied to the Website.

Detailed information on how to contact Dorlindon quickly and directly, as well as to request information, send notifications, request assistance or to file complaints are available on the Customer Service page.
 

2. Scope and amendments

The supply and sale of Products on the Website represent a distance sales contract regulated by the irish law.

The Customer is required to carefully read these General Terms and Conditions of Sale, that Dorlindon makes available also as a downloadable PDF file, at the beginning of this section of the Website and of which is permitted storage and reproduction, as well as any other information that Dorlindon provides on the Website, either before and during the purchase process.

The current General Conditions of Sale do not regulate the sale of products and/or the supply of services by parties other than Dorlindon which may be present on the Website through links, banners or hyperlinks. Before engaging in commercial transactions with these parties it is advisable to check their conditions of sale. Dorlindon is not responsible for the supply of services and/or the sale of products by these parties. Dorlindon does not conduct checks and/or monitoring of websites that can be consulted through these links. Dorlindon therefore takes no responsibility for the contents of these sites or for any mistakes and/or omissions and/or legal violations by the said websites.

The applicable General Conditions of Sale are those in force at the sending date of a purchase order. The General Conditions of Sale may be altered at any time. Any alterations and/or new conditions shall come into force from the moment of publication on the Website. Customers are therefore invited to visit the Website in order to verify any alterations and/or new conditions of the General Conditions of Sale.
 

3. Product Information

Each Product has a dedicated technical data page on the Website (from now on "Detailed Information Page"), which details the main characteristics. Dorlindon reserves the right to change the Detailed Information Page without prior notice.

Dorlindon will do its best to ensure that the photographs published on the Website as part of the Detailed Information Page represent the Product for sale as faithfully as possible. The colors may differ due to the settings of the computer or systems used to view the photos. Pictures of the Product in the Detailed Information Page may differ in size or in relation to accessories. For the purposes of this sales contract, the Product description contained in the order sent by the Customer will be relied on.

The Website may also contain information to support general purchases. This information is intended to be simply general material, not the actual characteristics of a single Product. For the purpose of this sales contract, the Product description contained in the order sent by the Customer will be relied on.
 

4. Product availability

Details of Product availability will be found in the Detailed Information Page of each Product.
Due to simultaneous purchases, the Product may not be immediately available for technical reasons after the transmission of the order, even though it was presented as "immediately available", and will need to wait for restocking. In this case the Customer will be immediately informed by email and may cancel the order at any time up to shipment of the Product by following the guidelines present in the email.

If the Product ordered is not available, the Customer will be immediately notified by email, and in any case within 14 days of receipt of the order. If the Customer has already paid and opts to cancel the order, Dorlindon will promptly reimburse the total amount paid, including delivery and any other costs for the Product as detailed in the "Payment methods" section.
 

5. Prices

All the prices of the Products published on the Website are expressed in Euro and are subject to VAT.

Dorlindon hereby reserves the right to alter the price of Products at any time, and also several times during the same day, without prior notice, it being understood that the price charged to the Customer shall be the one indicated on the Website at the time of placing the order and will not take account of any variations (either increases or decreases) subsequent to the transmission of the said order.
 

6. Purchase on the Website

The purchase of Products on the Website is permitted both for Customers which are “Consumers” as defined in the irish law and for Customers which are not “Consumers”.

A consumer is a natural person who, with regard to the purchase of Products, acts for purposes unrelated to any business, commercial, professional or craft activities interests that he/she may have. The indication of the VAT number during the purchase procedure is deem to be considered as an indicator of the execution of the purchase for purposes related to business, commercial, professional or craft activities.

The purchase of Products on the Website is only permitted for Customers who are 18 years old or over.

The purchase of Products on the Website can be carried out upon or without registration.

Registration with the Website is free and enables the Customer to:

  • check online the Order Status and "Order History" (in particular, clicking on the number of each order placed, it is possible to check its full details, including shipping and billing address);
  • access in faster way to after-sales services, by posting "online reports" directly from the "Order summary" page;
  • receive special offers on products;
  • manage information related to his personal profile (modify his personal data, modify the password, etc.);
  • change address details related to shipping or billing data;
  • change the status of the subscription to the newsletter.

The Customer hereby guarantees that the personal data provided during the registration procedure for the Website are complete and truthful and undertakes to indemnify and hold harmless Dorlindon from and against any all losses, damages and/or liabilities deriving from and/or in any way connected to the violation by the Customer of the regulations concerning registration with the Website or the conservation of registration credentials.

The Website is reserved for retail sale. Retailers, wholesalers or, in general, all those who wish to purchase Products for the purposes of subsequent resale, cannot submit orders on the Website for purchasing.

If there should be violations of the prohibitions set forth under the present article, Dorlindon reserves the right to under take all actions required to ensure that such irregularities cease immediately, including the suspension of access to the Website, the cancellation of the registration or the non-acceptance or cancellation of irregular orders.

Dorlindon reserves the right to refuse the orders made by Customers with which Dorlindon has a legal dispute, Customers that have previously violated Dorlindon's General Terms and Conditions of Sale or Customers involved in any type of fraud, an particularly, frauds concerning the use of credit cards.

Dorlindon is a virtual retailer whose commercial offering is exclusively based on goods from its own store. The Website is automatically updated continuously to ensure the best match between the availability provided by its own store and the one published on the Website.
Some Products may no longer be available after transmission of an order, including when different users purchase the same Product at the same time. In this case the Customer will be immediately informed by email, the order will be cancelled and the total amount paid, including delivery and any other costs for that order, will be refunded to the person who paid.

The Product purchased by the Customer are intended for use in the country they were ordered from. If, however, the Customer decides to take the items to another country, he will be responsible for adhering to both the exportation legislation of the order country and the importation legislation of the destination country. Dorlindon shall not be held liable and accepts no responsibility whatsoever.
 

7. Purchase process

The Customer can order the products offered on the Website, visible on the home page or on the dedicated sections of the Website, and described in the specifical product pages.

To place an order for the purchase of one or more products on the Website, and conclude the contract with Dorlindon, the Customer must fill out the online order form and send it electronically to Dorlindon, following the relevant instructions, after confirming to have carefully read the General Terms and Conditions of Sale, saved and printed a copy for his own personal use, using the link to the PDF file present on the online order form.

The order form contains information on the main characteristics of each product ordered and the relevant unit price (including all applicable fees and taxes), the type of payment that you may use in order to purchase each product, shipping terms for the purchased products, shipping and delivery costs, and references to the terms and conditions for returning purchased products.

The Customer will be asked to identify and correct possible input errors before submitting the order form.

Before the submission of the order form the Customer will be warned that this action implies the obligation to pay the indicated price, following the indications present in the "Payment methods" section of the present General Terms and Conditions of Sale.

The languages available for the completion of the contract with Dorlindon are italian and english.
The Customer Service can communicate with the Customer in italian and english.

The contract will be considered concluded when Dorlindon receives the electronical submission of the order form, and the order information sent by the Customer has been verified as correct.

After the order form has been submitted by the Customer and the contract concluded, Dorlindon will process the order and shall send to the Customer a purchase order receipt email, containing the order identification number (that the Customer must refer to in any communication with Dorlindon), the date and time of order, a resume of the products' main characteristics and detailed information on price (complete of taxes), a summary of the commercial and contractual conditions applied on the purchase, with a reference to the present General Terms and Conditions of Sale, and other useful informations for the Customer (return policy, warranty, etc.).

The purchase order receipt email contains all the personal information submitted by the Customer, that the Customer will promptly verify and eventually modify if not correct, contacting the Website's Customer Service.

The order form will be filed in Dorlindon's database for the time required to process the Customer's order and as provided by law. The Customer may access his order form by clicking on the section called My Order in the Customer Care area.

Dorlindon may not process purchases when there are not sufficient guarantees of solvency, when orders are incomplete or incorrect, or the products are no longer available. In the above cases, Dorlindon shall inform the Customer by email that the contract has not been executed and that Dorlindon has not carried out the purchase order specifying the reasons thereof. If the products displayed on the Website are no longer available at the time of the Customer's last access or once Dorlindon has received the order form, Dorlindon shall promptly inform the Customer of the unavailability of the ordered products.
If the order form has been sent and the price has been paid for items that are no longer available, Dorlindon will refund the amount paid for those items and the contract will be considered terminated.

By submitting an order form to Dorlindon, the Customer unconditionally agrees, accepts and undertakes to observe the provisions of these General Terms and Conditions of Sale in his contract with Dorlindon, as well as further conditions contained on the Website, through links, including the General Terms and Conditions of Use and the Privacy Policy. Should the Customer not agree with certain provisions of these General Terms and Conditions of Sale, he must not submit his order form for the purchase of products on the Website.
 

8. Payment methods

Payment for Products purchased on the Website may be made using the following payment methods.
 

8.1 Paypal

Payment for Products purchased on the Website can be made through PayPal using a PayPal account according to the terms and conditions of the contract agreed between the Customer and PayPal.

When paying by PayPal, the amount of the purchase will be debited by PayPal immediately, when transmitting the order.

Data entered on the PayPal site will be treated directly by PayPal and will by no means forwarded or shared with Dorlindon. Dorlindon has no knowledge of and does not store credit card data linked to the Customer's PayPal account, or data of any other payment instrument associated with PayPal.

In the case of payment by PayPal, the Customer will be redirected from the Dorlindon website ("www.dorlindon.com") to the PayPal website to carry out the payment process, following the PayPal procedures.
The order process will be considered concluded when, after the payment process, the Customer will be redirected to the Dorlindon website again ("www.dorlindon.com") showing the order confirmation page.

If the payment process is not possible due to wrong data input by the Customer or by other technical causes indicated by PayPal, the Customer will not be able to conclude the order confirmation procedure. If the Customer decides to abandon the PayPal payment page, he will be redirected to the Dorlindon website again ("www.dorlindon.com") showing the order confirmation failure page.

With any termination of the contract and subsequent cancellation of the order, the amount of the purchase will be credited back to the same Customer's PayPal account. The means of crediting the payment method connected to a PayPal account depend exclusively on PayPal. Once the purchase amount paid via a Pay Pal account is repaid, Dorlindon will under no circumstances be liable for any damages, direct or indirect, caused by delays that are attributable to Paypal or to the banking system in effecting the credit.

To guarantee the safety of payments made through the Website and to prevent fraud, Dorlindon reserves the right to ask for additional Customer information (e.g. a fixed line telephone number, or a two-sided copy of a valid identity card via email or fax).

The email will specify the time limit to provide Dorlindon with this information. This deadline will, in any event, be no longer than 4 working days from receipt of the request by the Customer. The order will be suspended until the information is received.

The Customer must provide the information requested within the time specified. If Dorlindon does not receive the documentation requested within the time limit, or the documentation is out of date or invalid, the contract will be considered cancelled and the order cancelled with Dorlindon reserving the right to seek redress for any damages incurred due to the improper actions of the Customer.

Termination of the contract will be communicated to the Customer within 4 working days of the end of the time limit to send to required documentation, as requested by Dorlindon. Termination will involve cancellation of the order and reimbursement of any amounts paid by the Customer.

If Dorlindon receives the requested documentation within the time limit then consignment terms for the Products will apply from the date of receipt of the documentation or the date of confirmation of the transaction by the fraud risk prevention Centre.
 

8.2 Credit Card

Payment for Products purchased on the Website can be made using a Credit Card through PayPal.
 

8.3 Bank transfer

Payment for Products purchased on the Website can be made through bank transfer.

If the Customer chooses the bank transfer as the method of payment, Dorlindon will communicate to the Customer, in the purchase order receipt email, in addition to already explained informations, also the bank account details to facilitate the payment.

The payment of the Products by bank transfer must convey not later than 7 working days after the notification of the receipt of the purchase order receipt email. Upon expiry of that period, the contract cand be considered terminated. If Dorlindon chooses to terminate the contract, an email will be sent to the Customer.

The delivery start beginning from the date of the received bank transfer and not from the date of the forwarding of the order as in the case the Consumer chooses other methods of payment.

To facilitate the connection between the received payment by bank transfer and the forwarded order, the Customer is invited to specify in the purpose of the credit transfer the following information:

  • the order identification number;
  • the date of the applied order;
  • name and surname of the holder of the order, if different from the account holder of the bank transfer.

It is also recommended to the Customer to send to Dorlindon, by email, the receipt of the bank transfer when it has been made.
 

9. Method, costs and terms of delivery

Delivery of the Products purchased on the Website is carried out in all the Countries listed and available in the "Country" form item of the order form.

However, delivery can only be undertaken within the borders of the Country choosen on the order form: the Customer is therefore obligated to include a shipping address that lies inside the phisical boundaries of the Country choosen in the order form. Orders that have a shipping address outside of its borders will be cancelled and the total amount paid will be refunded.

Delivery cannot be effected in the so-called "Free Zones," including, but not limited to, Livigno, Campione d'Italia (IT), Ahvenanmaan lääni (FI), Açores, Madeira (PT) Ceuta, Las Palmas, Melilla, Santa Cruz de Tenerife (ES), the Channel Islands (GB) or to P.O. boxes or post offices.

In the event that the shipping address is a P.O. box or a post office or in one of the places mentioned, Dorlindon will terminate the contract and refund any amounts paid. If the Customer is unsure about the location of a delivery address, he is invited to make a request using the "Online Customer Service" on the Website.

Delivery costs are charged to the Customer unless otherwise indicated in the Detailed Information Page section of the Product.

The amount of such costs (including VAT), which can vary depending on the delivery method chosen by the Customer, the destination, the number and the weight or volume of the Products that the Customer decides to purchase, will be clearly indicated before the Customer sends the purchase order. This amount will later be shown in the "Order Confirmation" and "Shipping Confirmation" emails.

Delivery costs applied on each order are always the result of the selection of the delivery solution with the lowest cost possible, between all the delivery solutions available to Dorlindon for the specific destination, dimension and weigth of the order to be delivered.

The total price of the order, with a separate indication of delivery costs and any other possible additional expense will be shown in the order summary, prior to transmission of the order. This amount due, which will also be detailed in the "Order Confirmation" email, will constitute the total amount owed by the Customer in relation to the order. The Customer is not required to pay any more than this amount.

If requested by the Customer, Dorlindon issues an invoice for mailed goods, sending it via email to the person making the purchase. The Customer can download a copy of the invoice in PDF format, after the successful delivery of the Products, from the "Order History" section. Issuance of the invoice relies on information provided by the Customer when the order is placed through the Website and that the Customer has declared to be true. No change in the invoice is possible after it has been issued.

Products delivery is at ground floor level, unless otherwise communicated by Dorlindon Customer Service. If delivery "to the floor level" is impossible the courier will deliver the Products to the ground floor. In case of refusal by the Customer, Dorlindon will charge him with transportation costs.

The Customer must point out any special features with regard to the place of delivery of the Products and/or its location. Failure to provide such information or the provision of incorrect details may lead to the Customer being charged for any additional costs that Dorlindon incur to complete delivery of the Products.

It is possible to buy "Additional Delivery Services." The list of "Additional Delivery Services" available in relation to single Products, their detailed description as well as an exact indication of their cost (in Euro, including VAT) will be detailed in the Product Technical Data or during the purchase process. The availability and cost of services is often related to the destination of the goods.

The risk of loss of or damage to the Products will pass to the Customer when he or a third party indicated by the Customer and other than the carrier has acquired the physical possession of the Products.

In the case Dorlindon has accepted and agreed with the Customer that the choise of the carrier will be made by the Customer, the risk will pass to the Customer upon delivery to the carrier, without prejudice to the rights of the Customer against the carrier.

If the right to return is exercised, the cost of "Additional Delivery Services" will not be reimbursed to the Customer.

It is recommended that on delivery the Customer checks:

  • that the number of packages delivered corresponds to the number indicated in the transport document email sent in advance;
  • that the packaging is not damaged, wet or otherwise altered;
  • that the sealing materials (adhesive tape or plastic) have not been tampered with in any manner.

It is in the Customer's interest to report any damage to the packaging or any mismatch in the number of packages by writing "GOODS UNCHECKED" and specifying the reason for the reservation (eg "Packaging broken", "package crushed ", etc..) on the courier's proof of delivery.

The unconditional acceptance of Products, in fact, does not allow the Customer to take legal action against the courier in case of loss or damage to the Products, except in the case where the loss or damage is due to intent or gross negligence of the courier itself and also with exception for partial loss or damage unknown at the time of delivery. In the latter case, however, the damage must be reported as soon as it becomes known and no later than eight working days after receipt.

The Customer acknowledges that collection of the Products is a specific obligation under the purchase contract. If non-delivery is due to the absence of the recipient at the address specified in the order form, after two unsuccessful attempts at delivery, the package will go "into storage". If the Products are not collected within five working days from the first delivery attempt the contract will be considered cancelled and the purchase order duly annulled. On cancellation of the contract Dorlindon will refund the total amount paid by the Customer, deducting the cost of unsuccessful delivery of the Products, the costs of returning the Products to Dorlindon as well as any other expenses incurred relating to the unsuccessful delivery caused by the absence of the recipient. Cancellation of the contract and the amount to be reimbursed will be communicated to the Customer by email.

Customers who fail to collect shipments more than twice cannot make purchases on the Website, regardless of the method of delivery or payment facility. Entities to place orders in violation of this provision can have their contract of purchase cancelled by right. Termination of the contract will be communicated to the Customer by email.

The shipping terms, i.e. the courier's responsibility for the Products, and delivery terms are specifically mentioned in order.
The shipping terms apply from the order transmission date, unless otherwise specified in the General Conditions of Sales or in the order.

Dorlindon commits itself to deliver the Products in the shortest time possible, 15 working days on average starting from the order or the payment confirmation, and at maximum in 30 days.

In the event that the Customer buys two or more Products, the shipping times will be those of the Product with the longest shipping time plus 24/48 hours for shipment consolidation at Dorlindon's logistics centre.

The Customer may need to be contacted to resolve a logistic or other problem relating to the delivery that may arise. In this case, the shipping terms shall be effective from the day the issue is settled by the contact with the Customer and delivery will be delayed accordingly.

In any case, the Customer is notified by a "Shipping Confirmation" email when Dorlindon entrusts the shipment to the courier. The email contains details of the delivery including: a list of Products shipped, the amount payed and the tracking number of the shipment linked to the courier's website (if available). Delivery time starts from the time the email is sent, depending on the type of delivery.

If the Products are not delivered or are delivered late under the terms of delivery indicated by Dorlindon, the Customer can contact the Customer Service to make a complaint. Dorlindon will examine the complaint promptly and will communicate the result to the Customer via email within 15 working days.

If the non-delivery or delay is not due to unforeseeable circumstances or force majeure, or is not attributable to the Customer, subject to the Customer's ordinary legal rights:

  • in the case of non-delivery, Dorlindon will promptly refund the Customer the total amount paid, including delivery charges and any other costs for additional delivery services or other services purchased by the Customer, and in any event within 10 working days of notification of the outcome of the complaint;
  • if the delivery is delayed for more than 10 working days, the Customer may request cancellation of the contract, resulting in a refund of the total amount paid by the Customer, including delivery charges and any other costs for additional delivery services or other services purchased by the Customer, and in any event within 10 working days of the request for cancellation of the contract.

 

10. Right of withdrawal

10.1 Right of withdrawal

A Customer who is a consumer has the right to withdraw from the contract of purchase of Products without incurring in any penalties and without stating any reason, within 14 calendar days of receiving the Product.
The Customer shall be borne only by the costs of the returning of the Products and the additional costs for having explicitly decided to use a type of delivery different from the one offered directly by Dorlindon.
 

10.2 How to exercise the right of withdrawal

To exercise the right of withdrawal, the Customer must inform Dorlindon of his decision to withdraw, within 14 calendar days of receiving the Products.

For this purpose, the Customer may:

  • use the online "Return Request" form available on the Website. The form is accessible, for the Customers that placed the order as Registered Customers, at the "My Orders" page in the "My account" section of the Website. Unregistered Customers can access the "Return Request" form by following the instructions contained in the "Returns" page of the "Customer Service" section of the Website. The "Return Request" form must be submitted within 14 calendar days of receipt of the Products.
  • use the "Withdrawal Form" provided as a printable PDF by Dorlindon in the "Returns" page of the Website. The duly completed "Withdrawal Form" must be sent to Dorlindon within 14 calendar days of receipt of the Products, or as attached file to an email to customerservice@Dorlindon.it or as a printed letter to the address indicated on the "Withdrawal Form".
  • use any other explicit form of declaration of his will to withdraw (email, letter, etc.). In this case the declaration, addressed to "Dorlindon, 278 Glasnevin Avenue, Glasnevin, Dublin 11, Ireland - Email: customerservice@dorlindon.it", must contain at least the following informations:
    • the sentence "I hereby give notice that I withdraw from my contract of sale of the following goods:";
    • the list of the Products to return (specifying for each the name, the Product Code and the quantity);
    • the sentence "Ordered in date:" and the date of Order;
    • the Order ID (example: "1-020415-013429-35");
    • the name and surname of the Customer;
    • the full address of the Customer;
    • the email of the Customer (the same used for the online Order from whitch the Customer intends to withdraw);
    • the signature of the Customer (only if the declaration is notified on paper);
    • the date of the present declaration.

The Customer is reminded that the burden of proof regard the exercise of the right of withdrawal shall lie on the Customer.

Once the explicit declaration of the Customer (in any of the prescribed forms, like the "Return Request" form, the PDF "Withdrawal Form", email, ect.) has been received by Dorlindon, within 14 calendar days starting from the day the Customer has received the Products, the Customer Service will promptly send to the Customer an email containing the confirmation of the will of the Customer to withdraw and instructions for the return of the Products, assigning a specific RMA (Return Merchandise Authorization) Code that the Customer is asked to use when returning the Products.

The Customer must return the Products to Dorlindon with no delay and in any case within 14 calendar days starting from the date of communication to Dorlindon of his decision to withdraw. For the purposes of this period the Products are considered returned when they are delivered by the Customer to the post office or courier.

The costs of returning the Products shall be borne by the Customer.

The Customer will be completely responsible for returns until receipt of the Products is certified by Dorlindon. The Customer is responsible for any damage that the Products may incur during transport. Dorlindon is not responsible in any way for any damage or loss or theft that may occur during shipment of goods returned by the Customer.

The integrity of the Products are essential for the exercise of the right of withdrawal. The Products can be tried, tested or checked but must not be used, washed or damaged. They must therefore be treated with ordinary care and returned undamaged, perfectly suitable for the use for which they are intended and with no signs of wear and tear or dirt, complete in all their parts, including all accessories and leaflets, with identification tags, labels, and any plastic fastener still attached to the Products intact and not tampered with.
The Products must be returned as received: in their original packaging, which are considered essential parts of the Products (and which must be enclosed in other packaging, with no RMA Code or any other label attached to the original packaging) and must include any accessories (e.g. hangers, garment covers, belts, manuals, etc.) and/or elements that form an integral part (e.g. any identification tag with disposable plastic fastener).

The right of withdrawal applies to the Products in their entirety. It may not be exercised in relation only to parts and/or accessories of the Products.

The Customer is responsible for the diminished value of the Products resulting from the handling of the Products other than that necessary to establish the nature, characteristics and functioning of the Products themself.

Dorlindon can withhold the refund until it has received the Products back (and verified the respect of the terms and conditions for the application of the right of withdrawal, and also the integrity of the Products, as specified before in this doument) or until the Customer has prooved to have returned the Products, whichever event happens before.

Dorlindon will proceed to reimburse the sums paid by the Customer for the Products, including the cost of delivery, but not the amounts paid for the purchase of additional delivery services (or the additional costs for having explicitly decided to use a type of delivery different from the one offered directly by Dorlindon), without undue delay and in any event within 14 calendar day from the date Dorlindon was aware of the exercise of the right of withdrawal.

Refund will be made by cancellation of the transaction using the same means of payment chosen by the Customer at time of order with the exception of those payments where this is not possible and which will be clearly indicated in the page under a choice of payment method. In the latter case, the Customer shall promptly provide, along with the return notification, the bank details to be used for reimbursement to allow Dorlindon to make payment.

If the recipient of the goods specified in the order form differs from the person who made the payment for the purchase, the refund of amounts under any exercise of the right of withdrawal, will be made by Dorlindon to the person who made the payment.

In case of the Products being returned are damaged during transport, Dorlindon will notify the Customer within 5 calendar days of receipt of the Products, to allow the Customer to exercise its rights under the contract of carriage. In this case, the Products will remain at Dorlindon and be available to the Customer, who can regain possession of the same. At the same time, the request for return will be rejected by Dorlindon because the Products did not meet the conditions about the integrity of the Products returned.

If the right of withdrawal does not apply, this exclusion will be made specificly and expressly communicated in the Detailed Information Page and, in any case, before the Customer proceeds to transmit the order.
In particular, the right of withdrawal does not apply in cases of tailor-made goods or goods made to the consumer's specifications, or clearly personalized (expressively personalized on request of the Customer, application of stickers, etc.).

If the withdrawal has not been exercised in accordance with the rules of the present General Terms and Conditions of Sale document and, in particular, in case the Products are not intact with all their parts and/or are not accompanied by their accessories and/or elements which are an integral part of the Product (e.g. any identification tag, disposable plastic fastener, hangers, belts, manuals, etc.) and/or is lacking the original packaging which is part of the Products, or when it is damaged or used by the Customer beyond the limit of ordinary due diligence, it shall lead to the partial refund of the amount paid for the Products to Dorlindon. The Customer may be liable for, and Dorlindon may deduct from any refund due to the Customer, any diminution to the value of the returned Products caused by his handling of the Products, save to the extent necessary to ascertain the characteristics, functions or nature of the Products. The value will be notified by email.

After receiving the email that notifies the diminution of the value, the Customer has 14 calendar days to choose to have the products re-delivered to him, at his expences. If he doesnot accept re-delivery Dorlindon reserves the right to retain the Products and the purchase price and recover Dorlindon's fees and expenses from the Customer.
 

11. Legal Warranty of Conformity

All the Products sold on the Website are covered by the Legal Warranty of Conformity (from now on "Legal Warranty").

The Legal Warranty is reserved for consumers. It therefore applies solely to Customers who have made the purchase on the Website for purposes other than entrepreneurial, commercial, craft or professional activities.

The seller (and, therefore, with regard to purchases made on the Website, Dorlindon) is responsible to the consumer for any patent defect existent at the time of delivery of the product and which manifests itself within two years (2) of the said delivery.

Dorlindon must be informed of the patent defect, under penalty of expiration of the guarantee, within two months from the date in which it was discovered.

Unless proven otherwise, it shall be presumed that the patent defects that manifest themselves within six months from the delivery of the product already existed at that date, unless this hypothesis is incompatible with the nature of the product or with the nature of the patent defect.

In order to take advantage of the Legal Guarantee, the Customer must provide proof of the date of the purchase and delivery of the good. It is advisable, to prove the purchase, for the Customer to keep the invoice sent by Dorlindon as well as the transport document or any other document that certifies the date of the purchase (such as the credit card statement or the bank statement).

A patent defect exists when the purchased good:

  • is not suitable for performing the function for which goods of the same type are normally used;
  • does not conform to the description provided by the seller and does not possess the features that the seller presented to the consumer as a sample or model;
  • does not display the features and performance that are normal for a good of this type, which the consumer could reasonably expect, considering also the declarations made in the advertising or on the labeling;
  • is unsuitable for the specific use desired by the consumer who informed the seller at the time of the completion of the contract, culminating in the seller's acceptance of the situation.

The Legal Warranty does not cover faults or malfunctioning caused by accidental incidents or due to the Customer's responsibility or by use of the product that does not comply with its intended use and/or the information contained in the technical documentation accompanying the product.

In case of a patent defect reported within the prescribed period, the Customer is entitled to the repair or free replacement of the good, or the reduction in the price, or the rescission of the contract.

If a Product purchased on the Website, during the period of validity of the Legal Warranty, should display what could be a patent defect, the Customer should inform Dorlindon by email at customerservice@dorlindon.it.

Dorlindon hereby reserves the right to ask the Customer to enclose the invoice and/or the transport document or any other document certifies the date of the purchase. The Customer Service will reply promptly to the communication, informing the Customer of the next steps that he should take.
 

12. Manufacturer's Conventional Warranty

The Products sold on the Website may also be covered, where clearly indicated, by a conventional warranty (also known as commercial warranty) issued by Dorlindon as manufacturer of the Products (from now on "Conventional Warranty"). The Customer can only assert his right to the warranty with the manufacturer. The duration, extension (including geographic extension), conditions and procedures, the types of damage/defects covered and the restrictions of the Conventional Warranty are indicated in the warranty certificate contained in the product packaging.

The Conventional Warranty has a voluntary nature and does not add to, replace, restrict, prejudice or exclude the Legal Warranty.
